FLIHI, Inc. (“FLIHI,” “we,” “us,” or “our“) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit our website at https://flihi.org (the “Site“) and interact with us. By using the Site, you agree to the practices described in this Privacy Policy.
This Privacy Policy is written for visitors located in the United States. The Site is not directed to persons located outside the United States, and we do not knowingly collect information from such persons.
1. Information We Collect
We collect information in three ways.
Information you provide to us. When you submit a contact form, request access to investor materials, schedule a call, sign a non-disclosure agreement, complete an accredited-investor self-certification, or otherwise communicate with us, you may provide your name, email address, phone number, employer, title, jurisdiction of residence, accreditation status, investment-related information, and any other content you choose to share. If you request access to our data room, you may also provide identity-verification information and documentation requested by our third-party verification provider.
Information we collect automatically. When you visit the Site, we (and our service providers) automatically collect information about your device and use of the Site, including IP address, browser type and version, operating system, referring URLs, pages viewed, links clicked, the date and time of your visit, approximate location derived from IP address, and similar technical information. We collect this information using cookies, web beacons, pixels, server logs, and similar technologies.
Information from third parties. We may receive information about you from third-party service providers, including identity-verification services, accreditation-verification services, payment processors, analytics providers, and publicly available sources.
2. How We Use Information
We use the information we collect to:
operate, maintain, and improve the Site and our services; respond to your inquiries and communicate with you; evaluate your eligibility to receive investor materials; verify your identity and accredited-investor status; provide access to gated materials, including the data room; deliver investor communications, updates, and offering materials to qualified prospective investors; comply with legal, regulatory, and contractual obligations, including securities laws and recordkeeping requirements; detect, prevent, and respond to security incidents, fraud, and unauthorized access; conduct analytics, research, and business planning; and enforce our Terms of Service and other agreements.
We do not sell or rent your personal information to third parties, and we do not use it for cross-context behavioral advertising.
3. Cookies and Analytics
The Site uses cookies and similar tracking technologies. Cookies are small data files placed on your device that enable us to recognize you and remember your preferences. We use:
Essential cookies that are necessary for the Site to function, including authentication and security cookies for gated areas such as the data room.
Analytics cookies that help us understand how visitors use the Site so we can improve it. We currently use Google Analytics and PostHog (or similar analytics providers). These providers collect information including pages viewed, time spent, click patterns, device information, and approximate location derived from IP address. You can learn about Google Analytics’ practices at policies.google.com/privacy and opt out by installing the Google Analytics Opt-Out Browser Add-on at tools.google.com/dlpage/gaoptout.
You can manage cookies through your browser settings. Disabling cookies may prevent some features of the Site (including the data room) from working properly.
4. How We Share Information
We share information only as described below.
Service providers. We share information with vendors that perform services on our behalf, such as website hosting, email delivery, analytics, identity verification, accreditation verification, data-room hosting, payment processing, and professional services (legal, accounting, advisory). These providers are contractually limited to using the information only to provide services to us.
Legal and compliance. We may disclose information when we believe in good faith that disclosure is necessary to comply with a legal obligation, subpoena, court order, or governmental request; to enforce our agreements or protect our rights; or to protect the safety of any person.
Business transfers. If FLIHI is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, information may be transferred as part of that transaction.
With your consent. We may share information for other purposes with your consent.
5. Data Retention
We retain information only as long as necessary for the purposes described in this Privacy Policy or as required by law. Investor-related information (including accreditation documentation, subscription materials, and related communications) is retained for the longer of (a) the period required by applicable securities laws and recordkeeping regulations, and (b) the duration of our ongoing relationship with you plus any applicable statute-of-limitations periods.
6. Your Privacy Rights
Depending on your state of residence, you may have certain rights regarding your personal information.
California residents (CCPA / CPRA). If you are a California resident, you have the right to (i) know what personal information we have collected about you, the categories of sources, the purposes for collection, and the categories of third parties to whom we have disclosed it; (ii) request a copy of the specific pieces of personal information we have collected about you; (iii) request that we delete personal information we have collected from you, subject to legal exceptions; (iv) request that we correct inaccurate personal information; and (v) not be discriminated against for exercising your rights. We do not sell or share personal information for cross-context behavioral advertising, so there is nothing for California residents to opt out of in that regard.
Other state residents. Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others) may have similar rights, including the rights to access, correct, delete, and obtain a portable copy of personal information, and to opt out of certain processing activities.
How to exercise your rights. To exercise any of these rights, contact us at privacy@flihi.com. We will respond within the time period required by applicable law. We may need to verify your identity before processing your request. You may designate an authorized agent to make requests on your behalf, subject to verification.
7. Security
We use commercially reasonable administrative, technical, and physical safeguards to protect information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. No method of transmission over the Internet or method of electronic storage is fully secure, however, and we cannot guarantee absolute security.
8. Children’s Privacy
The Site is intended for adults. We do not knowingly collect personal information from children under 13 (or under 16 where applicable). If we learn that we have collected information from a child without verified parental consent, we will delete it.
9. Third-Party Links
The Site may contain links to third-party websites and services. We are not responsible for the privacy practices or content of those third parties. We encourage you to read their privacy policies before providing information to them.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above. Material changes will be communicated by posting a prominent notice on the Site or, where appropriate, by emailing you. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Privacy Policy.
